This document constitutes as an electronic record in terms of Information Technology Act, 2000 and rules there under as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This document is published in accordance with the provisions of Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms and Conditions of Use (hereinafter referred to as "Terms of Use") of domain name [aashiyana.tatasteel.com], and all associated sites linked to aashiyana.tatasteel.com by Tata Steel Limited, its subsidiaries and affiliates (collectively, the "Site").  The Platform is the property of Tata Steel Limited, a company incorporated under the Companies Act, 1956 with its registered office at Bombay House, 24 Homi Mody Street, Fort, Mumbai – 400001, Maharashra, India and its branch offices (hereinafter referred to as "Tata Steel"). ACCESSING, BROWSING OR OTHERWISE USING THE SITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING. For the purpose of these Terms of Use, wherever the context so requires "You" or "User" shall mean any natural or legal person who has agreed to become a buyer on the Site by providing Registration Data while registering on the Site as Registered User using the computer systems. This section deals with conditions relating to the sale of products on the website and Terms of Use by Tata Steel to you.

Use of the Site is available only to persons who can form a legally binding contract under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Platform. If you are a minor i.e., under the age of 18 years, you may use the Site only under the supervision and prior consent/ permission of a parent or legal guardian. If it is brought to our notice or if it is discovered that you are under the age of 18 years and transacting on the Site, we reserve the right to terminate your membership and / or refuse to provide you with access to the Site.

Certain features or services offered on or through the Site may require you to open an account. You are fully responsible for maintaining the confidentiality of your account, password, and restricting access to your account, and you hereby accept responsibility for all activities that occur under your account as a result of your failing to keep this information secure and confidential. You acknowledge that the information you provide, in any manner whatsoever, are not confidential or proprietary and does not infringe any rights of a third party in whatsoever nature.

You may be held liable for losses incurred by Tata Steel or any other user of or visitor to the Site due to someone else using your ID, password or account as a result of your failing to keep your account information secure and confidential.

Tata Steel reserves the right to refuse service and/or terminate accounts without prior notice if these Terms of Use are violated or if we decide, in our sole discretion, that it would be in Tata Steel’s best interests to do so. You are solely responsible for all contents that you upload, post, email or otherwise transmit via the Site. The information provided to us shall be maintained by us in accordance with our Privacy Policy.

When You use the Site or send emails or other data, information or communication to the Site and Tata Steel, you agree that you are communicating with the Site and Tata Steel through electronic records which are legally identifiable and enforceable, and you consent to receive communications via electronic records (Email, SMS, WhatsApp, App Push) from the Site and Tata Steel as and when posted, communicated or required.

You agree that the Site is an online venue that enables you to purchase products listed on the Site at the price indicated therein at any time from any location. You further agree and acknowledge that the Platform enables the Buyer and Seller to transact on the Platform. Tata Steel is not and cannot be a party to or control in any manner any transaction between the Site's Users and Sellers. Accordingly, the contract of sale of products on the Site shall be a strictly bipartite contract between you and the sellers.

The role of the Site is limited to providing access to a communication system over which information made available by the manufacturer or seller or dealer or importer is transmitted or temporarily stored or hosted. The Site observes due diligence while discharging its duty as an intermediary under the Information Technology Act, 2000 and observes such other guidelines issued by the Central Government. The Site does not:

• Initiate the transmission;
• Select the receiver of the transmission; and
• Select or modify the information contained in the transmission.

Therefore, pursuant to the provisions of the Legal Metrology (Packaged Commodities) Amendment Rules, 2017, the responsibility of the correctness of the declarations displayed on the Site in relation to the products shall lie with manufacturer/seller/dealer/importer as applicable and not Tata Steel.

We store and process your Information including any sensitive financial information collected (as defined under the Information Technology Act, 2000), if any, on computers that may be protected by physical as well as reasonable technological security measures and procedures in accordance with the Digital Personal Data Protection (DPDP) Act, 2023, Information Technology Act 2000 and Rules made there under. Tata Steel’s Privacy Policy is applicable to the use of this Site, and its terms are made a part of these Terms of Use by this reference. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

Tata Steel may share personal information with our other corporate entities, affiliates and third parties. This disclosure may be required for us to provide you access to our services, to comply with our legal obligations, to enforce our user agreement, to facilitate our marketing and advertising activities, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our services. Tata Steel may disclose personal information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. IF YOU OBJECT TO YOUR INFORMATION BEING TRANSFERRED OR USED IN THIS WAY, DO NOT USE THE SITE.

Membership and browsing on the Site is free of charge. As per the Foreign Exchange Management (Transfer or Issue of Security by a Person Resident Outside India) Regulations, 2017 an “E-commerce marketplace may provide support services to sellers in respect of warehousing, logistics, order fulfilment, call centre, payment collection and other services.” Accordingly, the Site through various third-party service providers engages in order fulfilment services for orders placed on the Site and may charge a nominal fee for the same. All additional fees that may be charged shall be visible for confirmation on the order checkout page.

You are responsible for paying all fees (if any) associated with the use of the Site and you agree to bear any and all applicable taxes, charges, cesses etc. levied thereon.

(viii) Contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information.

(ix) Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.

(x) Is false, inaccurate or misleading.

Please note that in accordance with the Information Technology (Intermediaries guidelines) Rules 2011, in case of non-compliance with rules and regulations, User Agreement and/or any policies contained or referred to herein for access or usage of an intermediary computer resource, the intermediary has the right to immediately terminate the access or usage rights of the users to the computer resource of intermediary and remove non-compliant information. This right is in addition to all other rights and remedies available to the Platform against You either in this User Agreement or any policy contained herein, in any applicable law or under torts.

You agree to ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules there-under as applicable and as amended from time to time and also all applicable laws, rules and regulations and International laws (including without limitation all direct and indirect tax laws and all local, entry or usage related tax laws) regarding your use of our service and your listing, purchase, solicitation of offers to purchase, and sale of items or services. You shall not engage in any transaction in an item or service, which is prohibited by the provisions of any applicable law including exchange control laws or regulations for the time being in force. In particular you shall ensure that if any of your items listed on the Website qualifies as an "Antiquity" or "Art treasure" as defined in the Act ("Artwork"), you shall indicate that such Artwork is "non-exportable" and sold subject to the provisions of the Arts and Antiquities Act and shall ensure that it is not delivered to any buyer at any place outside India.

You may use information on the Site including data sheets, knowledge base articles, and similar materials purposely made available by Tata Steel for downloading from the Site, provided that you (1) not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) not make any additional representations or warranties relating to such documents.

Tata Steel make no representations regarding the use of or the result of the use/depiction of the contents on the Site in terms of their correctness, accuracy, reliability, or otherwise. Tata Steel shall not be liable for any loss suffered in any manner by the user as a result of depending directly or indirectly on the depiction of the Content on this Site. While we have taken precautions to avoid inaccuracies in content, this website, all content, information (including the price of products), software, products, services and related graphics are provided as is, without warranty of any kind.

You undertake that you are accessing the services on the website and transacting at your own risk and are using your best and prudent judgment before entering any transactions through the website. This Site may contain links to other independent third-party Web sites ("Linked Sites"). These Linked Sites are provided solely as a convenience to our users. Tata Steel does not control such Linked Sites and is not responsible for and does not endorse the content of such Linked Sites, including any information or materials contained on such Linked Sites. If you decide to link to any such Linked Sites, you do so entirely at your own risk.

Tata Steel may from time-to-time contract with third party payment service providers including banks to open nodal bank accounts under applicable Indian laws, to facilitate the payment between users i.e., buyers and sellers and for collection of Site Fees and other charges. These third-party payment service providers may include third party banking or credit card payment gateways, payment aggregators, mobile payment service providers or through any facility as may be authorized by the Reserve Bank of India for collection, refund and remittance, of payment or supporting the same in any manner.

While availing any of the payment method available on the Site, Tata Steel will not be responsible or liable, whatsoever in respect of any loss or damage arising directly or indirectly to you due to lack of authorization for any transaction, or exceeding the present limit mutually agreed by you and payment service provider, or any payment issues arising out of the transaction, or decline of transaction for any other reason.

Cancellation of an order for a product is allowed at no cost any time before we send the dispatch confirmation/ shipping notification relating to that product. The product for which “no return” or “no return and replacement” disclaimer is not given are eligible for return or replacement. The return policy period depends on the product category and the seller.  If at the time of delivery and/or within the applicable return policy period, if any defect is found, then the buyer of the product can ask for replacement from the seller subject to the following terms and conditions:

1. Notify seller of any defects in the product at the time of delivery of the product and/or within the applicable return policy period and the same product will be replaced in return of the defective product.

2. Replacement can be for the entire product or part of the product subject to availability of the same with the seller.

In case of cancellation before shipment, we initiate the refund within 24-48 business hours after receiving the cancellation request. In case of cancellation once the shipment has already been dispatched, we process the refund once the products have been received and verified at our warehouse.

In case of a return/ refund, we process the refund once the products have been received and verified:

• For payments done through credit/debit cards or net banking, the refund will be initiated to the same account from which the payment was made within 24-48 business hours of us receiving the products back. It may take 5-7 business days for the amount to reflect in your account.

Tata Steel reserve the right to withhold access to the Site and otherwise limit your access to the Site at Tata Steel’s absolute discretion if You behave towards any delivery partner working with Tata Steel in a manner which is discourteous, disrespectful, or abusive, or which otherwise may be deemed to be inappropriate or unlawful.

As required by applicable law, if you make a purchase of an amount equal to or above INR 2,00,000.00, then you are required to upload a scanned copy of your PAN card on the Site, within 4 days of making the purchase, failing which, the purchase made by the Customer will be cancelled. The requirement to submit the PAN card arises only once and need not be submitted again. Your order shall stand cancelled if there is a discrepancy between the name on the Site and the name on the PAN Card.

You agree to comply with all the applicable laws (including without limitation Foreign Exchange Management Act, 1999 and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by Reserve Bank of India from time to time, Customs Act, Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention of Money Laundering Act, 2002 and the rules made there under, Foreign Contribution Regulation Act, 1976 and the rules made there under, Income Tax Act, 1961 and the rules made there under, Export Import Policy of government of India) applicable to them respectively for using payment facility and the Site.

Tata Steel accepts no liability in any case whatsoever except the liabilities provided in the Terms of Use and other policies, including the following:

(i) Tata Steel requires sellers through an undertaking to ensure that descriptions, images, and other content pertaining to goods or services on their platform is accurate and corresponds directly with the appearance, nature, quality, purpose and other general features of such good or service.

(ii) Tata Steel provides the following information in a clear and accessible manner, displayed prominently to you at the appropriate place on its Site:

(a) details about the sellers offering goods and services;

(b) a ticket number for each complaint lodged through which the consumer can track the status of the complaint;

(c) information relating to return, refund, exchange, warranty and guarantee, best before or use before date, delivery and shipment, modes of payment, and grievance redressal mechanism, and any other similar information;

(d) information on available payment methods, the security of those payment methods, any fees or charges payable by users, the procedure to cancel regular payments under those methods, charge-back options, if any, and the contact information of the relevant payment service provider;

(e) information provided to it by sellers; and

(f) an explanation of the main parameters which, individually or collectively, are most significant in determining the ranking of goods or sellers on its Site and the relative importance of those main parameters through an easily and publicly available description drafted in plain language.

(iii)    Tata Steel does not provide any differentiated treatment between sellers of the same category. Tata Steel includes in its terms and conditions generally governing its relationship with sellers on its Site, a description of any differentiated treatment which it gives or might give between goods or services or sellers of the same category.

(iv) Tata Steel takes reasonable efforts to maintain a record of relevant information allowing for the identification of all sellers who have repeatedly offered goods or services that have previously been removed or access to which has previously been disabled under the Copyright Act, 1957, the Trade Marks Act, 1999 or the Information Technology Act, 2000.

(v) Tata Steel ensure that it informs the information provider at the time of collecting information directly from such person of the fact that the information is being collected, the purpose for which the information is being collected, the intended recipients of the information, name and address of the agency that is collecting the information and name and address of the agency that will retain the information.

(vi) Tata Steel does not engage in any dark pattern practice including false urgency, basket sneaking, confirm shaming, forced action, subscription trap, interface interference, bait and switch, drip pricing, disguised advertisement, nagging, trick question, saas billing and rogue malwares.

This Site is controlled and operated by Tata Steel and products are sold by respective Sellers. All material on this site, including images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. Material on the Site is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and You must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on any other Site or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which you receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

You agree that Tata Steel shall be under no liability whatsoever to you in the event of non-availability of the Site and/or any of the services or any portion thereof, occasioned by an Act of God, war, disease, revolution, riot, civil commotion, strike, lockout, flood, fire, satellite failure, failure of any public utility, man-made disaster, satellite failure or any other cause whatsoever beyond the control of Tata Steel (including any event which is caused by the failure or non-performance on the part of the content owners or the Site partners).

If any provision of these Terms is held invalid, void, or unenforceable, then that provision shall be considered severable from the remaining provisions, and the remaining provisions shall be given full force and effect.

These Terms of Use shall be governed, interpreted, and construed in accordance with the laws of India, without regard to the conflict of law provisions and for resolution of any dispute arising out of your use of the services or in relation to these Terms of Use. Notwithstanding the foregoing, you agree that:

· Tata Steel has the right to bring any proceedings before any court/forum of competent jurisdiction and you irrevocably submit to the jurisdiction of such courts or forum; and

· any proceeding brought by you shall be exclusively before the courts in Mumbai, India.
